BLAZINGTRIPS.COM – USER AGREEMENT

Welcome to Kodai Infinity Pvt. Ltd. (KIPL) and our brand, BlazingTrips.Com.

This User Agreement ("Agreement") governs the relationship between Kodai Infinity Pvt. Ltd. ("KIPL", "we", "us", or "our") and the individual(s) ("User", "you", or "your") accessing our websites, mobile applications, or utilizing our customer interface channels (including sales personnel, offices, call centers, advertisements, and campaigns).

Both User and KIPL are individually referred to as a 'Party' and collectively as the 'Parties'.

1. Applicability & Acceptance of Terms

By inquiring about or purchasing BlazingTrips.Com’s products and/or services through any channel, you are deemed to have read, understood, and expressly accepted this Agreement.

  1. Scope: All rights and liabilities of the User and KIPL are restricted to the scope of this Agreement.

  2. Service Specific Terms (TOS): Specific services (e.g., air tickets, holiday packages) may have additional Terms of Service (TOS). These will be provided to you and form an integral part of this Agreement. In the event of a conflict between a specific TOS and this Agreement, the terms of this Agreement shall prevail.

  3. Third-Party Rules: Third-party Service Providers (airlines, hotels, etc.) have their own operating rules, fare guidelines, and contracts of carriage. You are solely responsible for ensuring compliance with these third-party terms.

  4. Rejection of Terms: If you do not agree with any part of this Agreement or accompanying TOS, you must not utilize BlazingTrips.Com’s services.

2. User Account Security & Privacy

Account & Password Responsibility

When registering on BlazingTrips.Com platforms, you will create a password. You are entirely responsible for maintaining the confidentiality of your password and account details.

  1. You are fully liable for all activities occurring under your account.

  2. You must immediately notify BlazingTrips.Com in writing at support@kodaiinfinity.com of any unauthorized account use or security breach.

  3. KIPL will not be held liable for any loss resulting from unauthorized account use, with or without your knowledge. You may not use anyone else’s account at any time.

Third-Party Access Authorization

  1. By utilizing BlazingTrips.Com’s Account Access services, you authorize KIPL and its designated agents to access authorized third-party sites (such as banks and payment gateways) to retrieve requested transaction information.

Confidentiality Obligations

  1. Any information explicitly marked as Confidential by KIPL or BlazingTrips.Com must be kept strictly confidential by the User, unless disclosure is required by law or necessary to fulfill the obligations of this Agreement.

3. Platform Usage & Communication Policies

Website & Mobile App Restrictions

  1. Risk: Use of any information or materials on BlazingTrips.Com platforms is entirely at your own risk. It is your responsibility to ensure our services meet your specific criteria.

  2. Intellectual Property: You are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, licensing, or selling any information, software, products, or services obtained from BlazingTrips.Com platforms.

  3. Content Rights: Platform content is protected by copyright laws. KIPL reserves the right to modify, update, or delete any content at any time without prior notice.

Communication Consent & TRAI Compliance

By providing your contact information, you provide unconditional consent for BlazingTrips.Com to contact you via SMS, email, or voice call regarding booking confirmations, itineraries, cancellations, refunds, schedule changes, or incomplete bookings.

  1. Nature of Messages: You agree that these communications are transactional and requested by you, and do not constitute "unsolicited commercial communication" under the Telecom Regulatory Authority of India (TRAI) guidelines.

  2. Indemnification: You agree to indemnify KIPL against any damages, losses, or penalties imposed by TRAI or Access Providers due to erroneous complaints filed by you, or due to you providing an incorrect phone number or email address.

4. User Onus, Insurance, & Visas

⚠️ CRITICAL USER RESPONSIBILITIES

  1. Data Accuracy: You must cross-verify the accuracy of all data and bookings.

  2. Legal Compliance: You warrant that you will comply with all local and international laws applicable to your transactions.

  3. Transactions: BlazingTrips.Com is only responsible for transactions executed directly through BlazingTrips.Com systems. We do not screen, censor, or validate the legality of external user transactions.

Visas & Travel Documentation

  1. All bookings are subject to the individual traveler obtaining the appropriate visas, passports, and entry permits. BlazingTrips.Com is not responsible for any travel disruptions or cancellations arising from visa issues, and no refunds will be provided for untraveled bookings due to lack of proper documentation.

Insurance Obligations

  1. Unless explicitly included as a specific deliverable by BlazingTrips.Com, securing adequate travel insurance is the sole responsibility and option of the User.

  2. If insurance is included, it is governed strictly by the terms of the third-party insurance company. You must interface with the insurance company directly for any claims; BlazingTrips.Com offers no express or implied guarantees regarding claim approvals.

5. Force Majeure & Limitation of Liability

Service Operator Failures

You acknowledge that third-party service providers (airlines, hotels, transport operators) may occasionally fail to honor confirmed bookings due to reasons beyond BlazingTrips.Com's control—including weather conditions, labor strikes, insolvency, technical breakdowns, or government actions.

  1. If notified in advance, BlazingTrips.Com will make best efforts to provide alternative arrangements or process refunds if and when supported and refunded by the respective operator, minus reasonable service charges.

  2. BlazingTrips.Com acts purely as a facilitating booking agent and is not liable for service provider disruptions.

Technical Failures

  1. In the event of a technical or operational failure within BlazingTrips.Com that modifies or prevents the delivery of services, KIPL will refund the amount received from the customer, minus applicable cancellation or third-party fees. This refund completely discharges KIPL from all liability. Any additional expenses must be borne by the User.

Excluded Damages KIPL, BlazingTrips.Com, and its suppliers are not liable for any direct, indirect, punitive, incidental, special, or consequential damages, including loss of use, data, or profits.
Platform Accuracy We are not liable for unexpected platform downtime, data download issues, errors, or omissions on our pages or linked websites, though best efforts are made to keep platforms malware-free.

6. Operational Rights

Right to Refuse Service

  1. BlazingTrips.Com reserves the sole right to decline any customer order without assigning a reason. A service contract is only deemed complete once full payment is received and formally accepted by us.

Suspension & Account Termination

We may limit your activity, temporarily or indefinitely suspend your registration, or terminate your access without notice if:

  1. You breach this Agreement or accompanying TOS documents.

  2. We cannot verify or authenticate information you provide.

  3. We believe your actions infringe on third-party rights, violate applicable laws, or create legal liabilities for BlazingTrips.Com or other users.

Cancellation for Misrepresentation / Fraud

You must provide strictly accurate information. If BlazingTrips.Com suspects or discovers fraud, unauthorized booking requests, or misrepresentation:

  1. We reserve the unrestricted right to cancel bookings instantly without prior intimation.

  2. We will not be liable for any damages resulting from such cancellations made to protect our systems and genuine customers.

  3. We reserve the right to legally recover any outstanding dues from suspended users.

7. Marketing, Feedback, & Media

Offers & Solicitations

  1. To enhance your travel experience, you authorize BlazingTrips.Com to contact you with promotional offers via direct mail, email, phone calls, or SMS. You can opt out at any time by emailing support@kodaiinfinity.com or updating your preferences via our Privacy Policy.

Holiday Media & Social Media Usage

Any holiday pictures or videos shared by you during or after your trip in our support groups or via email may be used on BlazingTrips.Com's social media platforms for audience engagement.

  1. If you prefer that your media not be used, please notify us at info@kodaiinfinity.com, and your request will be implemented immediately.

8. Legal Framework & General Clauses

Indemnification

  1. You agree to indemnify, defend, and hold harmless KIPL, BlazingTrips.Com, its affiliates, partner websites, successors, and respective officers from any claims, losses, damages, liabilities, costs, and legal fees arising out of your breach of this Agreement, non-performance of your obligations, or violation of country-specific rules and codes of conduct.

Independent Relationship

  1. Nothing in this Agreement shall be deemed to constitute a partnership, joint venture, or agency relationship between the User and BlazingTrips.Com. Neither party has the authority to bind the other.

Severability & Headings

  1. Severability: If any provision of this agreement is found invalid or unenforceable, such invalidity applies only to that specific clause. The remaining provisions remain in full force and effect.

  2. Headings: Headings are included for convenience and reference only and do not define or limit the scope or intent of any section.

Modifications to Terms

  1. BlazingTrips.Com reserves the right to modify this Agreement, platform features, fees, and applicable terms at any time without prior notice. It is your responsibility to review these terms periodically.

Jurisdiction

  1. KIPL and BlazingTrips.Com disclaim all implied warranties imputed by the laws of any jurisdiction outside operational regions. This agreement is governed exclusively by the laws of India, and any disputes shall be subject only to the exclusive jurisdiction of the courts of Chennai, India.
